Dear Dads and legal people,

I really need help, I am a Father of 3 daughters, 12, 9 and 2 years old.

I’ve been subjected to a non molestation order which was ordered without my knowing and is malicious in nature, full of lies and I am currently sofa surfing, cannot see my kids (she is refusing access and I cannot access my property which I purchased 2 years ago).

I’m going slowly mad, I’m driven to the edge, feeling helpless and despondent and I really need some amazing help from my fellow Dad’s!

So it all started around three years ago when my Father agreed to give me my inheritance early… and I bought a house with it… until then we were living in a council flat. My wife has always wanted a house and from this point on she started a malicious campaign against me which I believe is a direct attempt to secure the house and make me penniless and homeless…. So far, it’s worked! GOD!

In Dec 2019 she made up allegations against me and I was subject to bail conditions that I could not go near the house. She then invited me back, welcomed me and I came back for a week and then called the Police to say I was breaking my bail conditions. I was put in prison for 2 weeks over Xmas and was released for the New Year. When the hearing happened, the judge found me non guilty on all charges which is absolutely true.

She sent me a drunk text message which is still on my phone on New Year Eve boasting she now had the house and everything… which I have copied below… This is the woman I am dealing with.

Two weeks ago she attacked me (I have bruising and photographs) and then called 999 to say I had attacked her and I was again arrested and the next day she had applied for a non molestation order which was granted without my knowledge. There is no damage to her at all. And the Police have dropped all charges against me however the order remains as it is a civil order.

The order itself is entirely false and some key points I noticed:
It says that I moved out of our marital home 18 months ago when I’ve actually been living there every day! Apparently this made it easier to get the order. Google actually keeps records of where I go, something called Google Timeline and everyday it shows me leaving for work and coming back home.
It says I was aggressive to our children when I have not been. A social worker is now involved.
I says I beat her when actually there is zero marks, bruising on her and only I have bruising and the police have dropped all charges against me. I did report her but they do not seem to be interested in taking this further.

So, I am left sofa surfing, I bought the house 2 years ago with inheritance from my Father…she has not put a penny in so I have no house, no kids and well no wife although a divorce is inevitable shortly.

She is refusing me access to the kids currently and I desperately miss then and I am sure they do me.

OK, that is some history… I would be happy to answer any questions if anyone needed more information.

I have a telephone court appearance on MONDAY 13th 2020… so just a few days.

What can I do?
I will once again dispute the charges however I am right now finding it very difficult to go to work… I am sofa surfing, staying with friends and trying to get on as best as I can…

I would be happy to make a statement or undertaking or something at the hearing if it helps…. I cannot honestly afford a solicitor… I am a handyman and my business has been devastated by CoVID + a lot of my tools are in my garage at home which I cannot go near…

So I have a telephone hearing in a few days and I would like / NEED please the absolute best advice on what my options are and what I could possibly do!
